Standard Terms and Conditions:
General
-Estimates are valid for 30 days from the date of issue. This estimate is based on all the agreed works being carried out. Therefore, any reduction in the work/s detailed in the estimate will require an updated estimate.
-All orders for Goods and Services, whether verbal or in writing, shall be deemed to be acceptance of these Terms and Conditions.
-Mad About Electrics reserves the right to withdraw or amend any estimate without notice at any time.
-Upon accepting our estimate, Mad About Electrics will order the Goods as detailed in the estimate. If, after this order being placed, the client cancels the order, the client will be liable for any costs incurred by Mad About Electrics for goods or time to that date.
-The person giving instructions to Mad About Electrics or ordering work or materials will personally be deemed to be the client unless it is made clear and agreed by the actual client to Mad About Electrics, who the client is.
-We assume all approval required to permit this work to proceed, i.e. landlord, local authority etc., has been given before our work commencing. Therefore, it is the client's responsibility to obtain all necessary permissions, licenses and consents required before the commencement of the services, the cost of which shall be the client's sole responsibility.
-Before any works are carried out, we would recommend a visit to the site to confirm the specification with the client. All estimates are provisional sums unless a site survey has been carried out with full drawings.
-Unless stated otherwise, the costs provided in this estimate assume standard working hours between the hours of 07:30 hrs - 16:30 hrs Monday to Friday inclusive. Work required outside these hours may attract out of hours rates. In addition, the costs provided in the estimate assume continuous and unhindered access to the site by prior arrangement with you.
-Delays caused by others will be subject to an additional charge of £240.00 plus VAT per day labour plus any other applicable costs incurred by Mad About Electrics.
-Any parking charges will be the client's responsibility and would be added to this estimate unless paid for by the client upfront.
-All accessories (switches, sockets etc.) included in this estimate are white plastic unless otherwise stated. Alternative finishes can be estimated separately. Alternative light fittings can also be estimated independently.
-The above estimate assumes that the correct main earth water and gas bonding is already installed, and the correct RCD (if required) protection is installed. If this is not the case, we will provide an estimate for the additional works.
-If required, it may be that you need an additional TV booster to make your TV system work correctly. If so, we will advise you of the costs before carrying out the work.
-If required, any sub-main supply/outdoor cabling will need digging in and laying in the ground as per wiring regulations. The cable route will then need making good once the cable has been installed. This work has not been allowed for and will not be carried out by Mad About Electrics.
-Any works not mentioned explicitly within this estimate are deemed not to be included within our costs.
-All patching and making good (if required) to be carried out by others (e.g. plastering, decorating etc., after first fix installation). Mad About Electrics have made no allowance for carrying out this work.
-Any rubbish/waste relating to the works is the responsibility of the customer. If we are asked to dispose of the rubbish/waste, there will usually be an additional cost to dispose of the rubbish/waste. The cost of this works out at £10 plus VAT per Gorilla bucket taken from the site and disposed of. If there is anything you would like Mad About Electrics to dispose of, please advise one of our staff before starting our work.
-Due to the nature of our works, there will usually be dust and debris relating to our jobs that is typically unavoidable. Mad About Electrics will attempt to cover the areas affected by our work with dustsheets. We will also try to hoover/sweep up most of the dust and debris once our works have been completed. If there are any items that you are concerned about being affected by the works, they must be removed from the site before we attend to carry out the works. If you have any concerns, please make our staff aware of them before any works have been carried out. Mad About Electrics will not be liable for any damage caused to customer's equipment/belongings caused by dust and debris from the associated works.
-If this build qualifies for reduced (0%, 5% or 15%) VAT, the final invoice will reflect this following appropriate paperwork. The client must make Mad About Electrics aware if the invoice has a reduced VAT rate before carrying out any works.
-All instructions for any installed items supplied by Mad About Electrics will be retained by our Electricians. We will hand this information to the client on completion of the works. Likewise, any information for any installed items supplied by the client or other trades will be passed back to the relevant people.
-In the event of any additional electrical works been required and/or requested, we will provide a separate or modified estimate for the additional works. These works will not be carried out until we have a written or verbal instruction or agreement from the customer accepting the additional costs unless we receive instruction from the client to carry out the work on a time and materials basis.
-The estimate does not include any allowance for investigating or repairing any existing electrical faults. However, in the case there are existing electrical faults, we will make the client aware and discuss how the client would like to proceed.
Data Protection and Privacy
All information, mail messages and other data stored on Mad About Electrics computer system will be treated as private and solely the property of the client at all times and will not be duplicated, copied, reproduced or viewed publicly in any way except with express or implied permission of the client and/or for the purpose of Mad About Electrics back up services and/or providing the client with the Services and/or for Mad About Electrics own internal purposes such as market research.
Design
-Any design information carried out or performed by Mad About Electrics remains copyright and is offered on the basis that Mad About Electrics only will carry out the works.
Intellectual Property
All design rights and other intellectual and industrial property rights relating to both our website and other media produced by Mad About Electrics are and shall remain the property of Mad About Electrics.
Commencement of Work
Upon commencement of work on-site, the client agrees to the terms and conditions laid out by Mad About Electrics in our terms and conditions.
Travelling to Site
-Working time includes travelling where it is an integral part of the job, for example, in the case of travelling to your property or a supplier to pick up materials for your job. This includes travel during regular working hours and travel between sites or clients since travelling is an essential part of the work.
Mobile Phones
-Our engineers will sometimes have to take business-related calls whilst they are at your premises. We will do our best to keep this to a minimum.
Testing, Certification and Part P Notification
-All test certificates are the property of Mad About Electrics until payment has been made in full. Mad About Electrics will hold them until payment has been made and received in full.
-If required, Part P notification will be made to the NIC EIC via their online registration service when payment has been received in full.
OZEV EV Charge Point Installations
-The estimate is based on the property having a working internet connection, a spare way in your broadband router for the data hub if required, and a spare 13amp socket to plug the data hub in. If this is not the case, additional costs incurred by Mad About Electrics will be passed onto the client.
Grants
-If Mad About Electrics is claiming a grant on behalf of the client (from the OZEV for EV Charge Point installations, for example), this will be deducted from our invoice once the grant has been approved by the relevant people and received by Mad About Electrics. However, until the grant has been received and paid in full, the client remains responsible for all costs relating to any labour or materials that Mad About Electrics has supplied.
Price and Payment
a) Payment can be made in one of 3 ways:
1) Online banking (BACS), Our payment details (sort code and account number) are shown on your invoice.
2) Online invoice payment link on the invoice by credit or debit card.
3) You can pay by cheque. Cheques should be made payable to Mad About Electrics.
b) New first-time customers will usually be required to pay a 25% advance payment deposit (fully refundable upon cancellation of works) to secure contractual commitments between Mad About Electrics and the customer.
c) Unless agreed by both parties in writing, payment in full must be made on completion of the specified works to Mad About Electrics as per the terms on our invoice.
d) The price for the Goods and Services is as specified in our estimate. If no estimate was given before work commenced, Goods and Services would be charged at the rates shown on the website.
e) Our payment terms, which are stated on our invoice, are seven days from the date the invoice is created. Full payment must be made for all labour and materials supplied by Mad About Electrics within seven days maximum from the invoice due date. Please do not ask us to carry out the work if you do not intend to pay within our 7-day terms. By asking us to carry out any work, you have agreed to these terms.
f) Stage payments will be requested where planned works take longer than 30 days. We reserve the right to request from you stage payments in the instance where works take longer than 30 days.
g) Unless otherwise agreed in writing by Mad About Electrics, payment for any Goods or Services shall be due upon the date of invoice.
h) Late payment will invalidate any discounts agreed upon.
i) If the client fails to make any payment on the day of it becoming due, Mad About Electrics shall be entitled to: (a) charge interest at the statutory rate of 8% above the Bank of England base rate accrued on a daily basis as well before and after judgment on the outstanding amounts from the due date to the date of payment; (b) cease any uncompleted work without any liability to the client.
j) Invoices that are not settled by 30 days after the due date will be passed to a debt recovery agency and will incur an administration fee of £25.
k) Payments that have been rejected will be subject to a £25 administration fee as well as any other costs incurred.
l) Retention fees: In the event there is a retention fee on a contract, and for unforeseeable circumstances, the main contractor changes or no longer manages the project, the client will be solely responsible for any outstanding payments. This includes any outstanding retention fees owed to Mad About Electrics at the end of the agreed defects period.
Warranty
-Mad About Electrics warrants its installation work to be defect-free for a period of twelve months from the date of installation. Such cover does not extend to goods not supplied by Mad About Electrics, physical damage to products, or any instance where the original installation has been altered or tampered.
-Manufactures warranty will only be honoured if the equipment has been serviced regularly to the manufacturer's recommendations.
-Where the Client supplies Goods or materials, Mad About Electrics accept no responsibility for any defects or damage and offers no guarantee for these Goods or materials.
Lamps supplied and installed by Mad About Electrics are covered by the following warranty:
-LED lamps have a manufacturer warranty on parts but not labour, usually 2 years.
-Halogen lamps, due to their characteristics and unpredictable life span, carry no warranty on parts or labour.
-All other lamps will be assessed on usage and installation specifics and agreed with the customer should a warranty claim be required.
Risk and Title of Goods and Property
a) The risk in all goods supplied shall pass to the client upon delivery.
b) All goods supplied shall remain property of Mad About Electrics until all sums due have been paid in full in accordance with these terms and conditions.
c) The client is responsible for ensuring that the property is insured for the duration of the installation work.
d) Where the Goods are faulty or do not comply with any of the contract, the client must notify Mad About Electrics within one week of delivery, and the client shall be entitled to replacement Goods. After one week, the client shall be deemed to have accepted the Goods and shall not be entitled to reject them after that time.
e) The client shall make all arrangements to take delivery of Goods whenever they are tendered for delivery.
f) Should payment not be made in accordance with these Terms and Conditions, Mad About Electrics reserves the right (and shall be allowed access by the client) to remove any Goods or materials supplied or fitted by Mad About Electrics. Mad About Electrics will not bear the cost of any damage caused by such removal.
Dispute Resolution
-In the event of a dispute, mediation is to be the preferred method of resolution.
-The NIC EIC Platinum Promise is a scheme all NIC EIC Approved Contractors and domestic installers are part of. It demonstrates our commitment to our customers to make sure that our installation work is safe and meets the required building regulations. The Platinum Promise will protect you should installation work undertaken by a NIC EIC registered contractor not meet the required building regulations or installation standards. Governing Law
-These Terms and Conditions shall be governed by and construed in accordance with the law of England, and the parties hereby submit to the exclusive jurisdiction of the English courts.
-These Terms and Conditions shall not affect the client's statutory rights as a Consumer.
